The High Court in Malawi has ruled against former Escom executives challenging their secondment to public universities.

On Tuesday, the High Court Civil Division in Blantyre discharged a judicial review order sought by Kamkwamba Kummwenda and Chrispin Banda. Judge Allan Muhome stated that the claimants’ rights were primarily private and could be addressed in the Industrial Relations Court (IRC).

High Court Discharges Judicial Review Order

Judge Muhome emphasized that the High Court should not handle matters that fall under specialized courts designed for labor issues. He noted that the claimants had an alternative remedy available through the IRC. The ruling reflects a clear delineation of responsibilities between the High Court and specialized labor courts.

Attorney General Frank Mbeta argued for the discharge of the judicial review order, highlighting that Kummwenda’s demand for K1.1 billion indicated he had alternative remedies. The court’s decision underscores the importance of following proper legal channels for employment disputes.

Context of the Case Against Escom

Kummwenda and Banda contended that their secondment by Chief Secretary Justin Saidi was unauthorized, as Escom operates as a state-owned firm under the Companies Act 2013. They argued that the Chief Secretary lacked the authority to second them to teaching positions.

The judge clarified that while Escom is a public company, it may also be considered a statutory body for certain purposes. This ruling reinforces the legal framework governing state-owned enterprises and their operations.

Next Steps for the Claimants

  • Kummwenda and Banda may pursue their claims in the Industrial Relations Court.
  • The claimants can seek remedies related to their employment contracts through the appropriate legal channels.
  • Further developments in the case may arise as the claimants respond to the ruling.

The ruling highlights the importance of proper legal channels for employment disputes in Malawi.
