Chief Justice Refers Presidential Petition to Constitutional Court for Review

The Zambian Chief Justice has received a presidential petition challenging the recent election results.

Chief Justice Mumba Malila confirmed the receipt of a petition via his private email, which raises questions about its formal filing. The petition, referred to as “the people’s presidential petition,” contests the outcome of the presidential election held on August 13.

Chief Justice Addresses Irregular Petition Submission

Justice Malila noted that using his private email for official court documents is highly irregular. He has utilized his administrative powers to refer the documents to the Constitutional Court for consideration. This referral aims to determine whether the petition has been properly filed according to legal standards.

The Judiciary of Zambia, through Deputy Director of Corporate Communications Kalumba Chisambisha-Slavin, acknowledged social media claims about the petition’s formal filing. However, Justice Malila clarified that this communication does not constitute a formal lodgement with the Judiciary.

Judiciary Urges Public to Await Court’s Decision

Justice Malila emphasized that all official court documents must adhere to prescribed filing procedures. He urged the public to rely on official channels for accurate information regarding court filings. The Judiciary has called for patience as the Constitutional Court prepares to make a determination on the petition.

Next Steps in the Petition Process

  • The Constitutional Court will consider the petition’s proper filing.
  • Affected parties will receive updates from the Constitutional Court in due course.

Zambia's legal system is navigating a significant challenge to its electoral process.
